Our terms of service outlined below must be reviewed before an order is placed. By placing an order with us, visiting our website or doing any business with our company, you agree to our terms of service.
You understand and agree to the fact that all 'unlimited' game servers come with 4GB of RAM, 5GB or more of SSD storage and 1 database allocation by default. This measure is in our best efforts of better protecting our systems from abuse. If you would like any of your game server resources upgraded, please get in touch with us directly. Please note that our staff team have the right to decide whether you're eligible for an upgrade.
You aknowledge and agree to the fact that it is your sole responsibiltiy of providing our company with your correct and presently-valid personal information. If you fail to provide us with your correct and valid information or you fail to keep it updated for the time you have an active customer account, we reserve to both, close your account and pass the case onto the police. Please note that impersonation is illegal. It is your legal responsibility to provide correct and up-to-date information to our company.
Any service that is not paid in full by the end of the first day of the billing term will be given a 24 hour grace period. If the payment is not made within the 24 hour grace period, Silky Servers reserves the right to suspend and/or terminate the customer's service for non-payment. Any applicable late payment fees may also be charged to the customer.
Silky Servers does not guarantee the availability of any hosting locations and reserves the right to add, append or remove any location at any time without any notification.
You may not use our services to publish content or engage in activity that is harmful to others or is illegal under the applicable law (this includes both the local and international laws, respectively), including, but not limited in connection with any of the following illegal, harmful or fraudulent activities:
Child Pornography – Hosting, distributing, or linking to pornography involving a person under the legal age.
Resource Usage Abuse – Consuming excessive amount of server resources, causing server performance issues - e.g. crypto-currency miners, viruses, bot-nets, etc.
DDoS/DoS Source – Being a source of (distributed) denial of service attacks.
DDoS/DoS Target – Being a target of (distributed) denial of service attacks.
Removing, amending or copying software that has been installed by our team (including our monitoring software).
File Scripts – The use of file dumps and mirror scripts (similar to Rapidshare).
Forgery – Faking an IP address, host name, e-mail address, or header.
Fraudulent Websites – Hosting or linking to websites that are intended to deceive the public; including, but not limited to sites listed at aa419.org and escrow-fraud.com.
HYIP – Hosting or linking to a high yield investment program website.
Identity Theft – Hosting, distributing, or linking to stolen account identification.
Infection – Hosting, distributing, or linking to exploits, trojans, viruses, bot-nets or worms.
Intellectual Property Infringement – Hosting, distributing, or linking to infringing content.
Investment Websites – Hosting, distributing, or linking to FOREX, e-gold exchange, second life/Linden Exchange, Ponzi, MLM/pyramid scheme, high-yield interest programs (HYIP) or other related websites.
IRC – Hosting, distributing, or linking to internet relay chat servers, including IRC scripts and bots.
Mass Storage – Storing mass amounts of backups, archives, videos, etc.
PayDay Loan Websites – Including any website related to PayDay loans, PayDay loan affiliate programs, etc.
Pharmacy Websites – Websites that engage in the illegal distribution of prescription medications; including, but not limited to: promotion, marketing, or sale of prescription medications without a valid prescription or license.
Phishing – Taking part in identity theft by e-mail or other means under false presence.
Proxy Website – Hosting or linking to anonymous proxy servers.
Bulk E-mail – No more than 500 e-mails of similar content can be stored, sent or received (Opt In).
Spam E-mail – Indulging in unsolicited commercial e-mails (UCE) or unsolicited bulk e-mails (UBE).
Spam List – Hosting, distributing, or linking to e-mail address lists or databases for spam purposes.
Spam Website – Hosting, distributing, or linking to a website that is or has been advertised by spam e-mails or other spam or fraudulent websites.
Spam Software – Hosting, distributing, or linking to software designed and developed for spamming or robo-calling (e.g. VOIP).
Spam Website – Indulging in unsolicited, bulk, or forged website advertisement in website logs, forums, guest-books, or social media.
Terrorist Website – Hosting or linking to a website advocating terrorism.
Toolz – Hosting, distributing, or linking to ‘toolz’ or instructional material on hacking and cracking software and systems or other illegal activities.
Warez – Hosting, distributing, or linking to ‘crackz’, ‘hackz’, ‘keyGenz’, ‘serialz’, or other pirated software.
Any other content or activity that is harmful to others or is illegal under applicable law as determined by Silky Servers in its sole discretion.
As a company, we take server abuse and copyright claims seriously. So, if we receive an abuse report or a DMCA notice, we will forward it to the client and allow up to 24 hours for a reply (their service will be suspended until they respond). If the client continues hosting copyrighted files and/or abusing their services, their service will be terminated without any warnings or a refund and the applicable legal action will be undertaken.
Silky Servers is situated in the United Kingdom and Wales and as such, we are required to comply with the laws and official policies of the United Kingdom and Wales, regardless of where the services are provided.
Silky Servers has systems in place that monitor all internet activity for breaches in the areas outlined above. If there is any reasonable belief that any of the regulations in our terms of service are being broken, or criminal activities are being undertaken, then these will be brought to the attention of the staff team. Anyone that is caught blocking our software in any way, will be warned; their service will be terminated if it re-occurs.
Silky Servers do not and will not provide any sort of refunds unless specified otherwise by the staff team. If you're not satisfied with our services for whatever reason, please get in touch with us immediately and we'll make it right for you.
Silky Servers reserves the right to terminate any applicable contracts in the case of any kind of financial or non-financial disputes and / or charge backs. A compensation fee of £1,000 GBP will also be charged in the case of such fraudulent activity. We advise all customers to contact us directly to settle any issues.
Silky Servers reserves the right to terminate any and / or all contracts at any time and it also reserves the right to charge any applicable contract termination fees and bills that have not been paid. For example, if a contract is terminated and it states that a one month's of notice must be given, the customer must pay the monthly cost, along with any terminations fees and charges.
At Silky Servers, we do not tolerate any sort of charge-backs or disputes, including PayPal disputes. Thus, we reserve the right to suspend and/or terminate your services without notice, should you file any kind of financial dispute against us. We also reserve the right to close your account without any notice. We advise all customers to contact us directly to settle any issues.
We reserve the right to pass your case onto a third-party debt collection agency, should we deem this necessary. We may do this if you haven't paid an owed balance to us or if you have chargebacked or disputed a transaction. We may pass some or all of your personal information to the debt collection agency of our choice, as required.
We reserve the right to report any illegal activity to the police. You also aknowledge and agree to the fact that you have the responsibity of reporting any illegal activity that's related to your company and our service immediately.
The account holder holds the responsibility for all activity undertaken using their service(s). The account holder is responsible for backing up their service data and Silky Servers shall not be liable in the event of data or service loss. Silky Servers should not be liable for any sort of damage caused.
You aknowledge and agree to the fact that any sponsored or partnered servers may not get the same level of support and they will not receive any free upgrades, etc. This is because these servers are provided for free. We may also decide to suspend or terminate any partnered or sponsored servers at any time with or without any notice.
You aknowledge and agree to the fact that whilst we provide support, we do not provide support with any things that we're not responsible for. This includes any modifications, plugins, maps, addons and anything else installed by the customer. However, you may purchase the relative paid addon for us to assist you with these things, but we do not guarantee any outcomes as things can be unpredictable and some plugins, maps and modifications may not be compatible, etc.
You aknowledge and agree to the fact that whilst we provide free website hosting with most of our services, we reserve the right to suspend or terminate any free website hosting services at any time and for any reason, with or without any notice. We also reserve the right to reject any free website hosting requests for any reason. Please also note that since this is a free service, the same level of support would not be provided for it.
We may amend our terms of service from time to time, with or without notice. Silky Servers will post changes to its terms of service directly on this page and encourages visitors to regularly check this page for any changes to its terms of service.
